Welcome to Murmur ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of the Murmur mobile application (the "App"). By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
Murmur is an AI-assisted voice journaling application. You may record voice entries; the App may transcribe audio, generate titles and summaries, assign mood tags and mood scores, display statistics (such as streaks and averages), and provide pattern and insight text based on your journal history. Optional subscription features may include deeper pattern analysis, priority processing, or other benefits described in the App.
Murmur is a wellness and self-reflection tool. It is not a substitute for professional medical, mental health, or therapeutic advice, diagnosis, or treatment. AI-generated summaries and insights may be inaccurate or incomplete. If you are in crisis, contact local emergency services or a qualified professional.
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the App. If you are under 18, you confirm you have permission from a parent or guardian where required.
You retain ownership of your voice recordings and journal content. You grant us a non-exclusive, worldwide, royalty-free license to host, process, transcribe, analyze, and display your content solely to operate, improve, and provide the App and its features, including AI processing through our subprocessors as described in our Privacy Policy.
You represent that your content does not violate applicable law or third-party rights and that you have authority to grant the license above.
Certain features rely on third-party AI and infrastructure providers. Outputs may contain errors. We do not guarantee specific results from AI features. Use of AI features is subject to your consent and our Privacy Policy.
Paid features may be offered via subscription. Pricing, billing cycles, free trials, and renewal terms are presented in the App and at the point of purchase. Subscriptions may auto-renew until cancelled in your App Store or Google Play account settings. Refunds are handled according to the policies of the platform where you purchased.
You agree not to misuse the App, interfere with its operation, attempt unauthorized access, scrape or reverse engineer the service except as permitted by law, or use the App for unlawful, harmful, or harassing purposes.
The App, including software, design, branding, and documentation (not including your content), is owned by us or our licensors and protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from the App.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
To the maximum extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of amounts you paid us in the twelve months before the claim or fifty dollars (USD), unless applicable law requires otherwise.
You agree to indemnify and hold harmless Murmur and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the App, or your violation of these Terms.
We may suspend or terminate access to the App if you violate these Terms or if we discontinue the service. You may stop using the App at any time. Provisions that by their nature should survive will survive termination.
These Terms are governed by the laws of Mozambique, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country apply. Disputes will be resolved as permitted by applicable law.
We may modify these Terms from time to time. We will post the updated Terms with a new effective date. Continued use of the App after changes constitutes acceptance unless applicable law requires a different process.
